Guarantee


                                                                                   Section I
1.  Your puppy is purebred and is entitled to registration with one or more of the following agencies: AKC, 
    APRI, or ACA . 
2.  Your puppy is current on all required vaccinations, has been de-wormed weekly starting at 2 weeks of
    age, and received all other medications recommended for various parasites including coccidia and giardia
    according to our program of  veterinary care established by our attending veterinarian Dr. Alan Thompson
    DVM of Farmington, AR (479-267-3276). 
3.  Your pet has received a thorough check and screen before shipping for any noticeable illnesses or
     genetic problems by our attending veterinarian and has been determined to have neither. 
4.  Breeder will replace puppy or issue a refund if within the first 48 hours of pick-up/shipping the
    buyer's veterinarian declares the puppy unfit for sale by identifying a “serious health issue” that clearly the  
    puppy obtained before leaving our care.   
5.  Breeder will replace puppy if within the first 12 months a licensed and qualified veterinarian detects an
    irreversible genetic disorder that can not be corrected and will ultimately cause the puppy's death or
    adversely affects the quality of life of the puppy so as to warrant euthanasia.
6.  We will accept the return of your puppy anytime for any reason if you become unable to care for him.
7.  This guarantee does not cover what in the bulldog breed is considered normal: cherry eye, entropion
    “loose” hips, skin allergies, elongated soft palate, stenotic nares (collapsed nostrils), uneven bites,
    un-descended testicles, demodex mange, inguinal or umbilical hernias.  


Section II
Miscellaneous Items:
  1.  Buyer is responsible for all expenses incurred or accumulated concerning the puppy, including; (but not    
      limited to) veterinarian bills, registration fees,  and transportation. 
  2.  Breeder assumes no liability or responsibility for the injury or death of puppy during any shipment or
      transportation once the puppy leaves the care of the breeder. 
  3.  Guarantee is non-transferable.
  4.  A licensed veterinarian must do all diagnoses and laboratory verifications. 
  5.  Although  the breeder can often make an accurate and experienced estimate of the future physical and
      mental characteristics of the puppy, due to the sometimes unpredictable nature of  genetics, it is
      reasonable that the breeder can not guarantee size, color, temperament, fitness breeding or showing.
  6.  Failure to comply with all or any part of the health guarantee by the buyer shall have the effect of fully
      and conclusively terminating any and every obligation or guarantee of the breeder to the buyer, and buyer
      shall be deemed to have accepted said puppy as is.
  7.  Refunds are only applicable within 48 hours from date of pickup/shipment.  After 48 hours, a 
      replacement puppy shall be issued and only under the terms of this guarantee.
  8.  For the first year the puppy should be fed a quality puppy food; such as,  Bil Jac, Eukanuba, Science 
      Diet, Iams, Diamond, Kasco, Royal Canin, Nutro-Max etc., or any food recommended by a licensed
      veterinarian.  (Yorkies puppies should not be fed lamb or rice based foods.)
9.  Replacement puppies shall be issued at the breeder’s earliest opportunity and shall be of equal value as
     determined by the breeder.
10.  Registration papers must be returned and received by the seller before replacement puppy is issued.
11.  No replacement will be issued if a female has been bred. 
12.  Cost of Litigation: In the event of any litigation over the terms herein, the cost of all legal fees for both
      parties will be absorbed entirely by the party who is found at fault by the court of jurisdiction of the seller.
13.  Entire Agreement: The terms and conditions herein constitute the entire agreement between the buyer(s)
      and seller/breeder.

Section III
Limitations:
1.  Buyer must have the puppy examined by a licensed vet within 48 hours of date of pick-up/shipping
    (excluding Sundays, or National holidays) and retain proof thereof. 
2.  Buyer must follow a licensed veterinarian’s guidelines for de-worming and vaccinations and maintain a
    written record thereof bearing a licensed veterinarian's official signature and letterhead.
3.  Buyer must notify the Breeder with 24 hours of any findings by a vet determining the puppy unfit for sale.
4.  Buyer must submit a detailed report to the Breeder from the vet who made the initial findings.  The report
    must be received by the breeder within 10 days following the date of the findings. 
5.  Buyer must provide the breeder with a written statement and full report from the licensed veterinarian who
    diagnoses a life threatening genetic defect within 10 days of the findings.  The breeder retains the right to a
    second opinion by a licensed veterinarian, and findings must concur.
 
Section IV
Concluding statement:
We the breeder have made every possible effort to deliver a quality, healthy puppy to the buyer; however,  due to the unpredictability of various natural, unnatural, or environmental causes of stress and illness in living beings, it is reasonable to limit the health guarantee to only the following  three terms and conditions.

A. Parvo or Distemper: Seller will replace your puppy if it dies of Parvo or distemper within 14 days    
   from the date of purchase.  Buyer must present seller with a written statement from a licensed veterinarian indicating the     above as the cause of death.

B. Irreversible Genetic Defects: Buyer has a 12 month guarantee against irreversible genetic defects. If said puppy is found     to have a genetic defect that can not be treated or corrected ultimately causing its death, or is serious enough to                 warrant euthanasia, the seller will replace the puppy.
